1. Provision of the Services (“As Is”)
The Services are provided “as is” and “as available.” Nexech does not guarantee that the Services will be uninterrupted, error-free, always accessible, or fit for a particular purpose. The Services may be temporarily interrupted due to maintenance, updates, infrastructure changes, or technical reasons.
2. Use at Your Own Risk
Use of the Services is the User’s responsibility. The performance/compatibility of your device, operating system, internet connection, and third-party services (e.g., ad networks, analytics infrastructures) may not be under Nexech’s control.
3. Third-Party Services and Integrations
The Services may include third-party services/SDKs (e.g., analytics, ads, measurement, embedded content). These third parties may have their own terms and policies. Subject to mandatory liabilities under applicable law, Nexech shall not be held responsible for outcomes arising from third parties’ service interruptions, incompatibilities, or policies.
4. Data Loss and Technical Issues
Nexech does not guarantee that outcomes such as data loss, system crashes, errors, delays, access interruptions, device malfunctions, or incompatibilities will not occur during or after the use of the Services. The User is responsible for taking necessary precautions on their own devices/accounts against such outcomes.
5. Limitation of Liability
To the extent permitted by mandatory applicable law, Nexech shall not be liable for indirect damages or consequential losses arising from the use of, or inability to use, the Services, including loss of business/income, reputational harm, data loss, or business interruption.
This Statement applies to the extent Nexech may limit liability under mandatory applicable law; your non-waivable rights under consumer protection laws remain reserved.
6. Updates, Changes, and Service Continuity
Nexech may add, remove, or change features to improve the Services; and may temporarily suspend or terminate the Services due to security, maintenance, prevention of misuse, or legal requirements.
7. Governing Law and Jurisdiction
This Statement is governed by the laws of the Republic of Turkey. The courts and enforcement offices of Aydın have jurisdiction over disputes.
8. Changes
Nexech may update this Statement. The current text is effective as of the date it is published.
