These Terms of Use (“Terms”) govern the use of all mobile applications, games, websites, and related services (the “Services”), including NextApp, provided by Nexech (“Nexech”, “we”). By using the Services, you agree to these Terms.

1. Definitions
- “Services”: Nexech’s applications, games, websites, digital content, and related features.
- “User”: The natural person using the Services.
- “Content”: Text, images, audio, video, interfaces, code, design, trademarks/brands, etc.
2. Acceptance and Updates to the Terms
2.1. These Terms remain in effect for as long as you use the Services.
2.2. Nexech may update the Terms. Updates become effective as of the date they are published through the Services or on the website. In case of material changes, reasonable notice may be provided where appropriate. Your continued use of the Services after a change means you accept the updated Terms.
3. Use of the Services and Prohibited Activities
3.1. You agree to use the Services in compliance with applicable laws.
3.2. The following are prohibited:
- Damaging the Services; reverse engineering; exploiting vulnerabilities; attempting unauthorized access; bot/spam activities
- Misusing the Services; overloading systems; use for cheating/abuse/exploitation purposes
- Use that infringes others’ rights (copyright, trademark, personality rights, etc.)
4. Permissions and Device Features
Certain features of the Services may rely on operating system permissions such as location, camera, microphone, files/media, nearby devices, and notifications. These permissions are optional; if you do not grant them, the relevant feature may not work or may work in a limited manner. You can manage, revoke, or restrict permissions at any time through your device settings.
5. Third-Party Services and Ads
The Services may include ads and may use third-party SDKs for advertising/measurement/analytics purposes. These third parties may have their own terms and policies. To limit personalized ads, you can manage your ad preferences in your device settings, reset the advertising identifier, or use the ad personalization controls provided by your device.
6. Subscriptions, Pricing, and Payment
6.1. Paid features/subscriptions in our applications may be offered via Google Play. Purchase, renewal, cancellation, and payment transactions are subject to Google Play rules.
6.2. For services purchased via our website (if any), cancellation/refund terms are determined separately by the Cancellation and Refund Policy and the information provided during purchase.
6.3. Refund and cancellation requests may vary depending on the type of purchase and the relevant platform/payment provider policies.
7. Changes to, Suspension, or Termination of the Services
Nexech may add, remove, or change features to improve the Services. The Services may be temporarily suspended or access may be restricted due to reasons such as security, maintenance/improvements, prevention of misuse, or legal requirements. Nexech may terminate the Services entirely; where applicable, reasonable notice may be provided.
8. Intellectual Property
All intellectual property rights in the Services and the Content belong to Nexech or its licensors. The right granted to the User is limited to a non-exclusive, non-transferable right to use the Services personally and lawfully. Copying, distributing, modifying, creating derivative works from the Services, or reverse engineering (unless permitted by applicable law) is prohibited.
9. Disclaimer of Liability
The Services are provided “as is” and “as available.” Nexech does not guarantee that the Services will be uninterrupted, error-free, or always secure. Interruptions, delays, data loss, incompatibility, and similar issues may occur due to the internet, device/operating system, third-party services, and network conditions. Subject to mandatory liabilities under applicable law, Nexech shall not be liable for indirect damages or consequential losses.
10. Privacy
Processing of personal data is carried out as described in the Nexech Privacy Policy and (for users residing in Turkey) the KVKK Notice section.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Turkey. The courts and enforcement offices of Aydın have jurisdiction over disputes. In consumer transactions, mandatory consumer protection laws and jurisdiction rules remain reserved.
